Parties

This agreement is between:

• 1. Auslicence; and
• 2. learner driver who has signed up to the Auslicence website

OPERATIVE PROVISIONS

Term of agreement

1. This agreement is in effect on the day the learner driver digitally agrees and terminates when the learner driver no longer does lesson with Auslicence

Warranty and agreement by learner driver

2. The learner driver warrants and agrees that they must have a valid learner’s permit or a driver’s license which allows them to drive legally in Australia.

3. The learner driver warrants and agrees to show their learner’s permit or driver’s licence to instructors for verification purposes.

4. The learner driver warrants and agrees that they have read and understood and consent to be bound by this Agreement.

5. If you are the parents or guardian of a learner driver aged under 18, then you are responsible for obligations and liabilities as set out in this Agreement.

Relationship of parties

6. The learner driver acknowledges and agrees that:

• 1. Driving instructors are completely independent.
• 2. Auslicence is only booking platform, connecting learner drivers and driving instructors.
• 3. Auslicence is not responsible for any agreement between learner driver and instructors.
• 4. Auslicence is not responsible or liable for any emotional, mental or physical damage, harm or loss to learner drivers, driving instructors and personal belongings.

Learner driver’s use of Auslicence website

The learner driver agrees:

7. Not to use other people’s account nor let others using your account.

8. That they only use the Auslicence website for its purpose to connect driving instructors and learners.

9. That Auslicence is only a driving lesson booking platform.

10. That they must provide current, true and correct information and amend their details as soon as possible.

11. Not to use the Auslicence website to promote any third parties.

12. That they will not do anything that damages the Auslicence website or reputation.

13. Not to use the Auslicence website for illegal activities or purposes.

Driving lessons

14. The learner driver agrees to comply with the following:

• 1. Being respectful to Auslicence staff and driving instructors.
• 2. Being respectful and follow all instructor’s instructions.
• 3. Acting safely and not putting other people and properties in danger.
• 4. Not asking driving instructors to do private lessons outside of the Auslicence platform.

Payment conditions

The learner driver agrees:

15. That they pay upfront and they are authorized to use the bank/credit/voucher cards for the transactions.

16. That any unauthorized payments will not be refunded and learner driver will be liable for it. Parents/guardians will be liable if learner driver is under 18.

17. Payments will become credits which can be used to purchase lessons and are held in the Auslicence account.

18. Credits are only used to purchase driving lessons or test packages and are non-refundable, non-transferrable and only the learner who credits have been issued to can use.

19. The credits have a validity of 3 years from the date of purchase and any unused expired credits will be forfeited to Auslicence.

Booking conditions

20. Auslicence may change this agreement from time to time upon 30 days notice.

• 1. Learners must accept the amended terms and conditions if wish to continue using the Auslicence website.

21. Cancelation or rescheduling functions are deactivated 10 hours before the lesson start time and charging the lesson is now at the driving instructor’s discretion.
